Terms of Use and Service Agreement
These Terms of Use govern the terms of use of the websites, APIs, SaaS services (e.g. Los Pos) and mobile applications offered by Los Soft (hereinafter referred to as the "Platform" or "Service"). Every user who uses the platform is deemed to have accepted the following terms in advance.
1. Intellectual and Industrial Property Rights
All intellectual and industrial property rights of all software, source codes, databases, interface designs, logos, algorithms and documents (including Los Pos brand and infrastructure) on the platform belong exclusively to Los Soft. The user is granted only a personal/corporate and non-transferable right of use (license). Copying, reverse engineering or unauthorized duplication of codes is strictly prohibited and subject to severe criminal sanctions.
2. "As Is" Presentation and Disclaimer of Warranties
Los Soft provides its software and services on an "AS IS" and "AS AVAILABLE" basis. Our company does not warrant in any way that the software will operate error-free, uninterrupted, virus-free or perfectly suitable for a particular commercial purpose.
3. Limitation of Liability (Zero Liability Principle)
Los Soft; cannot be held responsible for temporary or permanent interruption of the Service due to hardware failures, server outages, infrastructure updates, telecommunications problems, data synchronization errors or cyber attacks. Our Company cannot be held responsible for any direct, indirect, special or incidental material/moral damages, including loss of profit, business interruption, data loss, reputational damage, that may occur as a result of the User's use or inability to use the Platform. Responsibility for all operational data backup rests exclusively with the User.
4. User Obligations
The user is personally responsible for the security of his account information and passwords. Any legal and criminal liability that may arise as a result of the use of the account by unauthorized persons belongs to the user, and Los Soft is not obliged to compensate for any damage that may occur due to this situation. Our company reserves the right to suspend or permanently delete user accounts without prior notice if it detects suspicious activity or violations of the terms of use.
